Terms of Use

These terms are an agreement between you and Gradia. Please read them — section 5 covers health and safety, which matters because training carries real physical risk.

Gradia (“Gradia,” “we,” “us”) is provided by James Whelan. By downloading or using the app, you agree to these Terms of Use and to our Privacy Policy. If you don’t agree, don’t use Gradia.

1. Who Can Use Gradia

You must be at least 16 years old, or the minimum age of digital consent in your country, to use Gradia. If you’re under the age of majority where you live, you may only use Gradia with a parent or guardian’s consent. You’re responsible for activity under your account.

2. Your Licence to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Gradia on Apple devices you own or control, for your own non-commercial training. Gradia is licensed, not sold. Your use is also subject to Apple’s standard Licensed Application End User License Agreement; where these terms and Apple’s EULA conflict, Apple’s EULA governs for the app licence.

3. Your Account

You sign in with Sign in with Apple. Keep your Apple Account secure — you’re responsible for what happens through your account. You can delete your account anytime in Settings → Delete Account.

4. Subscription, Trial and Billing

Gradia is a subscription. New subscribers who are eligible start with a 14-day free trial that includes everything in the app; there is no separate limited free version. If you cancel before the trial ends you are not charged.

After the trial, a subscription is billed yearly or monthly at the price shown in the app before you confirm. Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically at the same price unless auto-renew is turned off at least 24 hours before the current period ends, and your Apple Account is charged for renewal within 24 hours of the period ending.

You can manage or cancel a subscription, and turn off auto-renewal, in Settings → your name → Subscriptions on your device. Cancelling stops the next renewal; it does not refund the period you are in. Any unused part of a free trial is forfeited if you buy a subscription before the trial ends. Apple processes every transaction under its own terms, and refunds are handled by Apple rather than by us.

Prices vary by country and include tax where applicable. If we change the price of a renewing subscription, you will be told before it takes effect and can cancel first.

5. Health, Fitness, and Assumption of Risk

Calisthenics is strenuous physical activity and carries a risk of injury. Read this section carefully.

  • Gradia provides general fitness and training information. It is not medical advice, and it is not a substitute for a qualified physician, physiotherapist, or coach.
  • Consult a healthcare professional before starting Gradia or any exercise program, especially if you’re pregnant, recovering from injury or surgery, or have any medical condition.
  • Stop immediately and seek help if you feel pain, dizziness, shortness of breath, or any symptom that concerns you. Don’t “train through” pain.
  • The Spotter is an assistive tool, not a safety device or a spotter in the human sense. It can’t prevent injury, catch you, or guarantee your form is safe.
  • You are responsible for training within your ability, using safe equipment, and choosing a safe environment. To the fullest extent permitted by law, you assume all risk arising from your training with Gradia.

6. AI Features

The Coach generates responses using AI. AI can be wrong, incomplete, or out of date. Treat Coach replies as general guidance, check anything important, and never rely on them for medical, diagnostic, or emergency decisions. If a message suggests pain, injury, or a health crisis, please seek qualified help.

7. Your Content and Club

You keep ownership of the content you create — your logs, notes, and anything you post. If you use Club, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, and display that content for the purpose of operating Club.

When posting, you agree not to share content that is unlawful, harassing, hateful, sexually explicit, infringing, or that depicts or endangers minors. We may remove content and suspend or terminate accounts that break these rules. You can report posts, block users, and delete your own posts. Content posted by other users is their responsibility, not ours.

8. Acceptable Use

Don’t misuse Gradia. In particular, don’t reverse-engineer, decompile, or tamper with the app; don’t scrape, resell, or commercially exploit it; don’t attempt to break its security or interfere with other users; and don’t use it to break the law.

9. Intellectual Property

Gradia, including its software, design, content, and brand, is owned by us and protected by law. These terms don’t give you any rights in our intellectual property beyond the licence above.

10. Third-Party Services

Gradia works with services run by others — including Apple, OpenAI, Anthropic, Strava, and the GORNATION store. Your use of those services is governed by their own terms and privacy policies, and we’re not responsible for them.

11. Disclaimers

Gradia is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don’t warrant that the app will be uninterrupted, error-free, or that any result (including a particular skill or fitness outcome) will be achieved.

12. Limitation of Liability

To the fullest extent permitted by law, Gradia and James Whelan will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, where that exclusion isn’t permitted).

13. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of Gradia, your content, or your breach of these terms.

14. Termination

You can stop using Gradia and delete your account at any time. We may suspend or end your access if you break these terms or if we stop offering the service.

15. Changes to These Terms

We may update these terms as Gradia changes. We’ll update the date above and, for material changes, notify you in the app. Continuing to use Gradia after a change means you accept the updated terms.

16. Governing Law

These terms are governed by the laws of Ireland, without regard to conflict-of-law rules, and the courts of Ireland will have exclusive jurisdiction, except where mandatory consumer-protection laws in your country of residence say otherwise.
